På hvilket tidspunkt burde entreprenør involveres for å utnytte handlingsrommet i jernbaneprosjekter best mulig?
Abstract
Det er en økende trend å gjennomføre større jernbaneprosjekter som totalentrepriser i Norge (Eriksson, et al., 2017). Hensikten med en totalentreprise er å overføre ansvar og risiko fra byggherre til entreprenør. Totalentrepriser skal gi entreprenør og rådgiver muligheten til å utvikle og optimalisere løsningene som skal prosjekteres og bygges. En oppfatning kan være at entreprenør har lite handlingsrom og få muligheter til å optimalisere løsningene i fasen de blir engasjert i. Dette kan være på grunn av lite tid og detaljerte funksjonsbeskrivelser. En annen grunn kan være at dagens regelverk og kontrollrutiner er så rigide at handlingsrommet blir minimalt.
Denne oppgaven skal se nærmere på hvilket tidspunkt entreprenør burde involveres for å utnytte handlingsrommet i jernbaneprosjekter best mulig. Handlingsrommet defineres som den frihetsgraden entreprenør har til å gjøre endringer og optimaliseringer innenfor de rammene som er gitt. Rammene består av funksjonsbeskrivelsen til prosjektet, teknisk regelverk, håndbøker og andre styrende dokumenter. For å svare ut oppgavens problemstilling er det utarbeidet tre forskningsspørsmål. Disse skal redegjøre for hvilket handlingsrom det er i dagens totalentrepriser, hvordan det blir utnyttet og hvordan handlingsrommet best mulig kan utnyttes i fremtidige prosjekter.
For å besvare oppgavens problemstilling og forskningsspørsmål er det gjennomført litteratur- og dokumentstudier samt casestudier. I casestudiene er det sett på tre ulike jernbaneprosjekter som er utført som totalentrepriser i regi av Bane NOR. Dokumentstudiet baserer seg på kontraktsdokumentene til prosjektene og Bane NORs styrende dokumenter for prosjektgjennomføring og veiledere for valg av kontraktstrategi. Resultatene fra dokumentstudiet er utgangspunktet for intervjuguiden. Denne er strukturert for å kunne svare best mulig på oppgavens forskningsspørsmål og ligger vedlagt oppgaven. Det er gjennomført totalt 12 intervjuer med nøkkelpersonell fra byggherre, entreprenør og rådgiver i de ulike prosjektene. Dataen fra intervjuene ble oppsummert og samlet, for deretter å bli analysert og vurdert.
Prosjektene som er studert er definert som mindre investeringsprosjekter i Utbyggingsdivisjonen i Bane NOR. Det er valgt prosjekter der det bygges langs eksisterende infrastruktur og driftsatt jernbane. Oppgaven har ikke sett på store investeringsprosjekter over 1 mrd. NOK der det bygges i «fri linje» eller mindre fornyelsesprosjekter der jernbanekomponenter byttes ut en-til-en. Graden av kompleksitet til prosjektene som er studert er varierende, og noen av resultatene kan benyttes for andre type prosjekter også.
Resultatene viser at det er lite handlingsrom i dagens kontrakter på grunn av detaljerte funksjonsbeskrivelser med mange henvisninger til løsninger fra detaljplanfase og en stram fremdriftsplan. Det er gjort noen mindre optimaliseringer i prosjektene, men på grunn av lite tid til prosjektering og mange bindende delfrister så får ikke entreprenør mulighet til å utforske og utfordre løsningene i stor nok grad. Teknisk regelverk begrenser også handlingsrommet da kravene i regelverket ikke alltid er like godt tilpasset fornyelsesprosjekter og det er lang behandlingstid ved å søke om avvik.
Dersom prosjektene hadde brukt mer tid på samhandling og forventningsavklaringer i starten kunne muligens noen av utfordringene ha vært unngått. Handlingsrommet øker ved å diskutere muligheter på tvers, og involvere de riktige ressursene. Bane NOR har rigide kontroll- og godkjenningsrutiner og bedre dialog med disse ressursene underveis kunne også bidratt til en mer effektiv prosjektgjennomføring.
Det kommer tydelig frem at ved å involvere entreprenør på et tidligere tidspunkt så vil handlingsrommet øke, da entreprenør får mulighet til å påvirke løsningene i samråd med byggherre. Dette gjelder spesielt i komplekse prosjekter der byggherre har stor nytte av å innhente kompetanse for å håndtere utfordringer og risiko best mulig. Mindre komplekse prosjekter der byggherre ønsker mer detaljstyring og kontroll har ikke nødvendigvis like stort utbytte av tidlig involvering av entreprenør. Insentivordninger kan også være en aktuell metode som kan bidra til å motivere entreprenør til å utforske og utfordre handlingsrommet, der aktørene deler besparelsen ved å gjøre optimaliseringer. It is an increasing trend to perform larger railway projects as design-build contracts in Norway (Eriksson, et al., 2017). The purpose of a design-build contract is to transfer responsibility and risk from the project owner to the contractor. Design-build contracts shall give the contractor and their consultant the possibility to develop and optimalize the technical solutions that is being projected and built. An opinion can be that the contractor has too little room of maneuver and few possibilities to optimalize the technical solutions at the time they are being involved, because of little time and a too specified functional description. Another reason can be that todays regulations and controll rutines are so rigid that the room of maneuver are minimal.
This thesis will take a closer look at which time the contractor should be involved to explore the room of maneuver in railway projects the most. The room of maneuver is defined as the degree of freedom the contractor has to do changes and optimize the technical solutions within the given frameworks. The frameworks of the project consists of the functional description, regulations, handbooks and other leading documents. In order to answer the thesis’ problem, three research questions have been prepared. The questions will find out what the room of maneuver is in todays design-build contracts, how the room of maneuver has been exploited and how the room of maneuver can be exploited the best way in future contracts.
In order to answer the thesis’problem and research questions, literature, document and case studies have been carried out. The case studies consists of three different railway projects, done as design-build contracts where Bane NOR is the project owner. The document study was based on the contract documents for the different projects and Bane NORs leading documents for project implementation and guides for choosing the right contract strategy. Results from the document study was the foundation to the interview guide. This was structured to answer the thesis’research questions the best possible way and is attached to the thesis. A total of 12 interviews have been conducted with key persons from the project owner, contractor and consultant in the various projects. The data from the interviews were summarized and collected, and then analyzed and considered.
The projects that have been studied are defined as smaller investment projects in the Development Divison in Bane NOR. Projects have been chosen where construction is carried out along existing infrastructure and operating railway. The study did nok look at larger investment prosjects over 1 billion where construction is carried out in a “free line” og smaller reneval projects where railway components are replaced one-for-one. The degree of complexity of the projects that are studied varies, and some of the results can be used for other types of projects as well.
The results show that there is little room for maneuver in current contracts due to detailed functional descriptions with many references to solutions from earlier phases and strict progress plans. Some minor optimizations have been done in the projects, but due to little time for planning and many binding deadlines, the contractor does not get the opportunity to explore and challenge the technical solutions to a large enough extent. Technical regulations also limit the room of maneuver as the requirements in the regulations are not always as well adapted to renewal projects, and the processing time when applying for dispensations is long.
If the projects had spent more time on interaction and clarifying expectations in the beginning, some of the challenges could possibly have been avoided. The room of maneuver increases by discussing opportunities with other parties, and involving the right resources. Bane NOR has rigid control and approval routines and better dialogue with these resources along the way could possibly contribute to a more efficient project.
It became clear through the results that by involving the contractor at an earlier stage, the room of maneuver will increase, as the contractor will have the opportunity to influence the solutions in consultation with the project owner. This applies especially in complex projects where the project owner benefits greatly from acquiring expertise to handle challenges and risks the best way possible. Less complex projects where the project owner wants more detailed management and control do not necessarily benefit as much from the early involvement of the contractor. To implement incentives in the contracts can also be a method to motivate the contractor to explore and challenge the room of maneuver, where the parties share the savings by making optimizations.
