La barna snakke - En litterær oppgave om barns rett til medvirkning i barnevernet

Abstract

Barns rett til medvirkning er et sentralt og overordnet tema i den nye barnevernsloven. Forskning viser at barnevernet ikke alltid legger til rette for at barn får medvirke i egen sak, og at barnets alder er en faktor som kan være et hinder for medvirkning. Mangel på språk hos barnet er en annen faktor som kan medføre at ansatte i barnevernet velger å la være å sørge for at barnets rett til medvirkning blir overholdt. I tillegg kan man la seg prege av barnets behov for beskyttelse, noe som igjen påvirker muligheten barnet har til å medvirke. Det er likevel ikke kun faktorer som hindrer medvirkning. Forskning viser også at god relasjonsbygging mellom den ansatte i barnevernet og barnet, kan bidra positivt inn på barnets mulighet til å medvirke. I forlengelsen av funnene fra tidligere forskning kan man gå nærmere inn på hva ansatte i barnevernet kan gjøre for å sørge for at barnets rett til medvirkning blir ivaretatt. Blant annet er det viktig at ansatte i barnevernet finner nye perspektiver på medvirkning, slik at man i mindre grad krever at barnet må ha språk for å kunne medvirke. I tillegg til dette er det viktig at de ansatte i barnevernet er opptatt av relasjonsbyggingen til barnet, samt å øve seg på å snakke med barn eksempelvis ved hjelp av snakkesimulator på nett.

Children´s right to participation is a statutory right in the new Child Protection Act from 2021. Research shows that facilitation for children to take part in their own case does not always occur, and that the child´s age is a factor that can negatively affect the child´s ability to participate in their own case. At the same time, the child´s lack of language can also mean that the employee in child protection choose not to ensure that the child´s right to participation is respected. In addition, one is often characterized by the child´s need for protection, which also affects the child´s ability to participate. However, it is not only factors that prevent participation. Research also shows that good relations between the employee in child protection and the child itself, can contribute positively to the child´s opportunity to participate. In the extension of the findings from previous research, it is possible to investigate what the employees in child protection can do to ensure that the child´s right to participation is taken care of. Among other things, it is important that employees in child protection find new perspectives on participation, regardless of the child´s ability to speak for the child to participate. In addition to this, it is important that the employees in the child protection are interested in creating good relations between themselves and the children, as well as practice talking to children by using the talking-simulator on the internet.
