Hvordan bidrar Etikkrådet til at Oljefondet hensyntar menneskerettigheter i sine investeringer?

Abstract

Oppgaven studerer hvordan Etikkrådet bidrar til at Statens pensjonsfond utland (SPU) ivaretar hensynet til menneskerettigheter i sine investeringer. Vi forsøker å identifisere styrker og svakheter ved dagens system for observasjon og utelukkelse av selskaper. Videre tester vi tre ulike hypoteser som har en naturlig sammenheng med den overordnede problemstillingen.

Analysene er gjennomført med bakgrunn i dokumentgjennomgang og intervjuer med informanter som har ulike perspektiver til temaet. Innledningsvis presenteres teori, historikk og bakgrunnsinformasjon som danner bakteppe for drøftelsene. I tillegg presenteres teori knyttet til statlige pensjonsfond og samfunnsansvarlige investeringer. Vi forklarer deretter metodene som brukes i analysedelen, samt dataene og informasjonen fra intervjuene som blir analysert.

De mest interessante funnene er at Etikkrådet gjennomfører et grundig og uavhengig arbeid i forkant av anbefalinger til Norges Bank og at terskelen for utelukkelse er høy. Mye tyder på at Norges Bank i stor grad følger de anbefalinger som gis av Etikkrådet. Et annet funn er at Etikkrådet er prisgitt den informasjon de mottar for å kunne utføre sitt arbeid, dette kan være krevende med tanke på å avdekke mulig risiko for menneskerettsbrudd. I så måte vil forbedret informasjonsteknologi i stor grad kunne revolusjonere overvåkningsprosessen.

The thesis examines how the Council on Ethics contribute to the GPFG safeguarding human rights considerations in its investments. We identify strengths and weaknesses in the current system for the observation and exclusion of companies. Furthermore, we test three hypotheses linked to the overall research question.

The analyses were conducted based on document reviews and interviews with informants with different perspectives. In addition, theory related to government pension funds and socially responsible investments is presented. In the following chapters, we explain the methodology and present the findings in the document analysis and interviews.

The most interesting findings are that the Council on Ethics conducts thorough and independent work before advising the central bank of Norway and that the threshold for exclusion is high. There are strong indications that Norges Bank largely follows the Council on Ethics's advice. Another finding is that the Council on Ethics is at the mercy of the information it receives, which can be challenging in uncovering the risk of human rights violations. In this way, improved information technology could significantly revolutionize the surveillance process.
