Abstract
Tvang mot barn og unge i barnevernsinstitusjon er å regne som en stor inngripen i deres personlige integritet. Som sosialarbeider på barnevernsinstitusjon har du blant annet et ansvar å ivareta barnets rettsikkerhet, utøve god omsorg og hjelpe barnet til utvikling og mestring. I noen tilfeller åpner loven opp for utøvelse av tvang dersom det kan begrunnes etter lovens vilkår. I et hjelpeyrke som sosialarbeider krever tvangstiltak nøye etiske vurderinger. På bakgrunn av dette er oppgavens problemstilling: Hvordan kan tvang i barnevernsinstitusjon påvirke det miljøterapeutiske arbeidet? Og hvordan kan sosialarbeideren forsøke å forebygge bruk av tvang? Det er en teoretisk oppgave som bruker systematisk litteratursøk som verktøy for å belyse oppgavens tema. Oppgaven diskusjon bygger i hovedsak på vitenskapelige artikler, i tillegg er det tatt i bruk tidligere pensum fra studiet, rapporter og lovverk.
Oppgavens diskusjon tar for seg hvordan det miljøterapeutiske arbeidet kan bli påvirket gjennom relasjonsarbeid, maktaspektet og læring. Oppgaven ser videre på hvordan tvangstiltak kan påvirke barnets opplevelse av trygghet og tillitt i institusjonen, og hvordan tvangstiltak kan påvirke samspillet mellom barna og de ansatte. Det synes at gode miljøterapeutiske ferdigheter samt evne til å reflektere rundt egne holdninger rundt tvangssituasjoner, samt kunnskap om lovverket er av betydning for forebygging av tvang. En vesentlig del av miljøterapeutisk arbeid er relasjonsbygging, og trekkes derfor frem som en viktig faktor i forebygging av tvang. Coercion against children and young people in child weldare institutions is to be considered a major intrusion in their personal integrity. As a social worker at a child welfare institution you have, among other things, a responsibility to make sure the child’s legal security is taken care of, execute good care and help the children with development and coping. In some cases, the law allows the exercise of coercion if it can be justified according to the terms of the law. In helping professions, such as social workers, coercive measures require careful ethical assessments. Based om this, the thesis’ issue is: How can coercion in a child welfare institution affect the environmental therapeutic work? And how can the social worker try to prevent the use of coercion? It is a theoretical assignment that uses a systematic literature research as a tool to illuminate the assignment’s theme. The discussion of the thesis is mainly based on scientific articles, in addition has it been used previous syllabuses from the study, reports and legislation.
The thesis’s discussion looks at how the environmental therapeutic work can be affected through relations, power aspects and learning. The thesis further examines how coercive measures can affect the child’s experience of safety and trust in the institution, and how coercive measures can affect the interaction between the children and the staff. It seems that good environmental therapeutic skills, as well as the ability to reflect one’s own attitudes towards coercive situations, and knowledge of the legislation, are important for the prevention of coercion.
