Barns medvirkning i barnevernets undersøkelse

Abstract

Barns rettigheter har de siste 30 årene fått økende oppmerksomhet på flere arenaer. I den nye barnevernsloven som trådte i kraft 1.januar 2023, har barns mulighet til medvirkning fått enda et løft. I denne bacheloren setter jeg søkelyset på praksis, og oppgaven omhandler ulike faktorer som påvirker barn og unges mulighet til å medvirke i barnevernets undersøkelsesfase. For å belyse temaet har jeg sett på barnevernfaglig teori for å se på det faglige grunnlaget man har med seg i de vurderingene man tar som barnevernspedagog, og hvordan det påvirker vurderingene. De rettslige rammene for barns mulighet til medvirkning har blitt fremstilt for å skape et bilde av hvilke rettigheter og begrensninger lovverket gir. Barnevernspedagogens barrierer for å legge til rette for barns medvirkning har blitt fremstilt, og barnets opplevelser rundt medvirkning er trukket frem, basert på resultatene som fremkommer i rapporter og artiklene. Videre har ulike artikler og rapporter blitt gjennomgått for å se om det er et mønster som kan indikere noen gjentakende faktorer som fremmer eller hemmer barns mulighet for medvirkning i barnevernets undersøkelse. Målet med bacheloren er å bidra til en økt bevissthet rundt kompleksiteten i barnevernsarbeid, og en økt forståelse for hvor viktig barnets medvirkning er for å sikre gode og treffsikre avgjørelser til barnets beste.

In the last 30 years, children`s rights have received an increasing amount of attention. The new Child Protection law, which came in to force on 1. January 2023, children`s opportunity has been given a new boost. In this bachelor's degree, I focus on the practice area, and the thesis sets the spotlight on which various factors that affect children and young people's possibility to participate in the child welfare services investigation phase. In order to shed light on the topic, I have looked at theory from child protection professional theory to look at the professional basis you bring with you in the assessments you make as a child welfare employee, and how that affects the assessments. The legal framework for children's opportunity to participate has been presented to create a picture of what rights and limitations the legislation provides. The child welfare employee`s barriers for facilitating children's participation have been presented, and the child's experiences of participation have been highlighted, based on the results that appear in the reports and articles. Furthermore, the various articles and reports have been reviewed to see if there is a pattern that can indicate any repetitive factors that promote or inhibit children's opportunity to participate in the child welfare services investigation. The aim of the bachelor's degree is to contribute to an increased awareness of the complexity of child welfare work, and an increased understanding of how important the child's participation is to ensure good and effective decisions in the child's best interests.
