Barnevernets møte med foreldrekonflikter

Abstract

Tema for denne oppgaven er foreldrekonflikt i barnevernet. De foreldrekonfliktsakene som barnevernet må ta stilling til kjennetegnes ofte ved at foreldrene har vært i konflikt lenge, og at det er vanskelig å få dem til å samarbeide. Tidligere har man tenkt at slike saker ikke er et anliggende for barnevernet, men de siste årene har man blitt mer oppmerksom på skadevirkningen en slik konflikt kan ha på barn, og de politiske føringene nå er dermed at barnevernet skal involveres for å sikre barnas utvikling. Foreldrekonfliktsaker er et komplekst tema i barnevernet, blant annet fordi man jobber i et krysningspunkt mellom barneloven og barnevernloven da disse sakene ofte handler om uenigheter knyttet til samvær og barnefordeling. Poenget med denne oppgaven er å belyse hvilke utfordringer barnevernet opplever når de jobber med disse sakene. I dette inngår blant annet begrensningene man møter på knyttet til hjemmel i lov og utfordringer med å kommunisere med foreldrene. Problemstillingen i oppgaven er om barnevernet er riktig instans for foreldrekonflikter. Metoden som har blitt brukt i denne oppgaven er litteraturstudie, som er en kvalitativ tilnærming. Her har det blitt gjort et systematisk søk etter litteratur for å besvare oppgavens problemstilling. Kildene har blitt valgt på grunnlag av relevans og pålitelighet. Oppgaven presenterer en rekke faktorer som kan gjøre det utfordrende for barnevernet å gjøre en god nok jobb med disse sakene og faktorer som kan begrunne hvorfor barnevernet burde undersøke saker som omhandler foreldrekonflikter. Funnene i oppgaven taler for at barn tar nok skade av foreldrekonflikt til at det burde være et anliggende for barnevernet, men samtidig ser man at man ikke har funnet den mest hensiktsmessige måten å jobbe med disse sakene på for å sikre barnets beste.

The theme of this thesis is parental conflict in the eyes of child protection services. The parental conflicts that end up in the child protection services is often recognized by having been long lasting and that there are issues getting the parents to cooperate properly. In earlier times these kinds of cases have not been seen as a matter of the child protection services, but in resent years there has been a growing attention to the damaging effects of conflicts on children, and therefore the policy now is that the child protection services should be involved to ensure the children’s development. Parental conflicts are a complex theme, among other things because of the cases being in the crossing point of the child law and the child protection services law because the conflicts often are regarding visitation and child distribution. The point of this thesis is to shed light on the challenges that comes with the child protection services working with these cases. This includes, among other things, the challenges regarding limitations in the work because of the law and the challenges of communicating with the parents. The question I am seeking to answer is: are the child protection services the right body for parental conflicts? The method used in this thesis is literature study, which is a qualitative approach. There has been a systematic search for literature to answer the thesis’ issue. The sources have been chosen due to their relevance and credibility. The thesis presents several factors that may contribute to the challenges of the child protection services’ abilities to do a well enough job and factors that contributes to why the child protections services should investigate cases of parental conflict. The findings in the thesis advocates for children taking enough damage by parental conflicts for the child protection services to be involved, but at the same time it shows that one has not found the most appropriate way to handle these cases to ensure the best interests of the child.
