Samvær til barnets beste.

Abstract

Bacheloroppgaven omhandler samvær mellom biologiske foreldre og barn som er plassert i fosterhjem. Barn har rett til å vedlikeholde kontakten med sine biologiske foreldre, dersom retten ikke står i konflikt med barnets beste. Det har blitt gjort en undersøkelse på hvordan vurderingen av samværsordninger kan være kompleks og utfordrende for barneverntjenesten. Derfor tar oppgaven utgangspunkt i problemstillingen:” Hvordan kan barneverntjenesten tilrettelegge for en god samværsordning med hensyn til barnets beste”. Metoden som har blitt brukt for å belyse problemstillingen er litteraturstudie. Diskusjonen for denne oppgaven er hvordan samvær kan skape muligheter for barnet, men også hvilke utfordringer det kan føre med. Resultatene viser at det å yte støttetjenester til biologiske foreldre og fosterforeldre er viktig for å tilrettelegge for og opprettholde en god samværsordning for alle involverte parter. Barneverntjenesten har derfor en viktig rolle i etableringen av støttende forbindelser og samarbeid mellom de involverte. Samlet sett påpeker denne studien at det ikke er noen overordne regler som kan anvendes i vurderingen av samvær til barnets beste. Derfor bør den endelige beslutningen baseres på en grundig vurdering av hvert enkelt barns situasjon.

The bachelor thesis is about the contact between biological parents and children who are placed in foster homes. Children have the right to maintain contact with their biological parents, if the right does not conflict with the child's best interests. The study has been made of how the assessment of visitation arrangements can be complex and challenging for the child welfare service. Therefore, the thesis is based on the problem: "How can the child welfare service facilitate a good visitation arrangement with regard to the child's best interests". The method that has been used to shed light on the problem is literature study. The discussion for this thesis is how the contact can create opportunities for the child, but also what challenges it can lead to. The results show that providing support services to biological parents and foster parents is important to facilitate and maintain a good visitation arrangement for all parties involved. The child welfare service therefore has a significant role in the establishment of supportive connections and cooperation between those involved. Overall, this study points out that there are no general rules that can be applied in the assessment of contact for the best interests of the child. Therefore, the final decision must be based on a thorough assessment of each child's situation.
