Barns medvirkning i undersøkelsesfasen

Abstract

Barns medvirkning har de senere årene fått stadig større fokus, både i lovverket og i praksis. Barns medvirkning i undersøkelsesfasen er tema for denne oppgaven, hvor jeg vil belyse problemstillingen: Hva hemmer og fremmer barns muligheter til å medvirke i undersøkelsesfasen? Jeg har tatt utgangspunkt i forskning gjort på feltet, fortrinnsvis fra Norge. Av faktorer som kan hemme medvirkning, vil jeg ta for meg organisatoriske faktorer, individuelle faktorer ved den ansatte, relasjon mellom den ansatte og barnet og hvilke begrensninger undersøkelsen selv setter, i form av tidsbegrensning. I drøftingsdelen tar jeg for meg disse faktorene, og ser på hvordan disse kan påvirke barns mulighet til å medvirke i undersøkelsesfasen. Dette sees særlig i sammenheng med at medvirkning er en rett barna har, men også noe som må legges til rette for av den ansatte. I oppgaven vil jeg avslutningsvis se på spenningsforholdet de ansatte til stadighet befinner seg i, mellom å skulle se på barnet som aktør i eget liv og ekspert, og det at den ansatte vet barnets beste, gjennom kunnskap og erfaringer ervervet gjennom utdanning og praksis. Oppgaven avslutter med at det trengs mer forskning på feltet, særlig på medvirkning i undersøkelsesfasen, og hvordan det kan legges til rette for medvirkning for de yngste barna.

Childrens participation have in the recent years recieved more attention, both in the law and on the workfield. Childrens participation in the investigation phase is the theme for this assignment, where I`ll by presenting the problem: What prevents and promotes childrens opportunities in the investigation phase. I will refer to research done on the field, first and foremost from Norway. Of factors that can prevent participation, I`ll look into organizational factors, individual factors with the employee, the relation between the employee and the child, and what limitations the investigation phase itself has, by having a time limit. In the discussion part I will look into these factors, and see how they can affect childrens opportunities to participate in the investigation phase, seen in relation to that participation is a right the child has, but also something the employee has to ensure. In this assignment I`ll also look into the tension the employees at all times finds themselves in, between seeing the child as an expert in its own life, and the fact that the child needs help in seeing whats in the best interest, and that other people may better see whats in the best interest of the child. The assignment concludes with the need of more research on the field, in particular participation in the investigation phase, and how one can facilitate participation for the youngest children.
