Virker en fengselsstraff for en straffedømt i Norge rehabiliterende, og hva er i så fall en sosialarbeiders rolle i denne prosessen?

Abstract

Kriminalomsorgen har som formål å fullbyrde straffereaksjoner på en måte som motvirker kriminelle handlinger, samtidig som det skal beskytte samfunnet. Videre bygger kriminalomsorgen på humanistiske prinsipper som skal sikre en innsatt i norske fengsler individuell tilrettelegging med hensikt at de skal rehabiliteres til å løslates som en lovlydig borger. Sosialarbeidere innenfor kriminalomsorgen har en allsidig rolle i arbeidet med innsatte, og vil på mange måter være et bindeledd mellom innsatte og aktuelle helse- og velferdstjenester. Rehabiliteringsaspektet står sentralt i fengselshverdagen, og ligger til grunn for alle tilbud, programvirksomheter og aktiviteter som tilbys i fengslene. Herunder inngår blant annet normaliseringsprinsippet som bidrar til å sikre en tilværelse som er lik ellers i samfunnet, medvirkning i avgjørelser som angår en selv, samt individuell behandling av kriminelle vansker.

Med bakgrunn i dette, vil denne oppgaven ha som hensikt å belyse hvordan kriminalomsorgen forvalter rehabiliteringsarbeidet, samtidig se på sosialarbeiderens rolle i dette arbeidet. Problemstillingen er derfor som følger; virker en fengselsstraff for en straffedømt i Norge rehabiliterende, og hva er i så fall en sosialarbeiders rolle i denne prosessen?

Metodevalget for oppgaven er litterær, og vil derfor diskutere funn gjort i relevant litteratur opp mot kriminalomsorgens formål med straffen, som er rehabilitering. Funnene viser til kritikkverdige områder om hvorvidt innsatte faktisk rehabiliteres, og viser til manglende samhandling mellom kriminalomsorgen og andre organisasjoner og tjenester. Likevel fremmes sosialarbeiderens rolle som en sentral brikke i rehabiliteringen, samtidig fremheves både innsattes motivasjon til endring og miljøarbeid som viktige elementer for en vellykket rehabilitering.

The purpose of The Norwegian Correctional Services is to carry out sanctions in a way that counteracts criminal acts, while at the same time protecting society. Furthermore, the Correctional Services are based on humanistic principles that are intended to ensure that an inmate in Norwegian prisons is individually facilitated with the intention that they should be rehabilitated to be released as a law-abiding citizen. Social workers within The Norwegian Correctional Services have a versatile role in the work with prisoners, and in many ways will be a link between inmates and relevant health- and welfare services. The rehabilitation aspect is fundamental to the prison life, and forms the basis for all services, offending behavior programmes and activities offered in prisons. This includes, among other things, the principle of normalization that contributes to ensuring a life that is equal elsewhere in society, participation in decisions concerning oneself, as well as individual treatment of criminal difficulties.

Based on this, this thesis will aim to shed light on how The Norwegian Correctional Services manage the rehabilitation work, while at the same time looking at social workers role in this work. The problem to be discussed is therefore as follows; does a prison sentence for a convicted in Norway rehabilitate, and if so, what is a social worker's role in this process?

The choice of method for the thesis is a literary thesis and will therefore discuss findings made in relevant literature up against the purpose of The Norwegian Correctional Services, which is rehabilitation. The findings point to reprehensible areas about whether prisoners are rehabilitated or not, and points to a lack of interaction between The Norwegian Correctional Services and other organizations and services. Nevertheless, the social worker's role is promoted as a key element within rehabilitation, while at the same time highlighting both the inmates' motivation and the environmental work as important elements for a successful rehabilitation.
