Evig eies kun et dårlig rykte - rusreformen i et brukerperspektiv

Abstract

De siste årene har narkotikapolitikken i flere land vært gjenstand for omfattende reformer, gjennom ulike former for avkriminalisering. Argumentasjonen for slike reformer er hovedsakelig å redusere stigmatisering av brukere av narkotika, men det er også en økende tilslutning til at straff ikke har en tilstrekkelig effekt på bruksprevalens. Internasjonale organisasjoner som FN og WHO har uttrykt en oppfordring til statene om å redusere bruk strafferettslige sanksjoner mot brukere av narkotika, da dette kan utgjøre et hinder for retten til helse. I Norge har regjeringens avkriminaliseringsreform «fra straff til hjelp» vært gjenstand for heftig debatt. Sosialt arbeid har et brukerfokus og er opptatt av å styrke de som berøres av sosiale problemer. I den forbindelse er hensikten med denne oppgaven å belyse hva brukerne selv mener om reformen, og hvordan disse perspektivene kan bli ivaretatt om reformen implementeres. Gjennom en systematisk gjennomgang av høringssvar fra brukerorganisasjoner på rusfeltet. Utfyllende litteratur ble innhentet gjennom å benytte strategier fra systematisk litteratursøk, samt håndsøk i relevant pensumlitteratur. Funnene viser at brukerorganisasjonene på mange områder stiller seg bak den foreslåtte modellen slik den presenteres i NOU 2019: 26 (rusreform - fra straff til hjelp). Det er imidlertid gjort noen endringer i lovendringsforslaget som kan hevdes å trosse brukernes meninger. Disse blir diskutert i tillegg andre temaer som utmerket seg i høringssvarene; ønsket om en mer helhetlig rusreform og en endring i holdninger rundt personer som bruker narkotika. Brukermedvirkning blir bragt opp som en viktig forutsetning for ivaretakelse av brukerperspektivet om reformen implementeres. Implikasjoner disse funnene kan ha for sosialt blir diskutert avslutningsvis.

Drug policy has in recent years been subject to reforms in many countries, through various forms of decriminalization of illicit drugs. Arguments for such reforms is mainly the destigmatization of drug users, but there is also a growing acknowledgment of the fact that punishment does not have sufficient effects on prevalence of use. International and transnational organizations, for instance UN and WHO, have urged states to reduce criminal sanctions towards drug use, as it may inhibit the right to health. In Norway, the current governments drug reform “form Punishment to Support” has been subject of heated debate. Social work is described as putting the client in center, and to promote empowerment of those who are affected by social issues. The purpose of this thesis is to identify and bring to light the opinions of people who use drugs, on drug reform. Further it aims to discuss how, moving forward, we can ensure inclusion of the perspectives of the affected community. A systematic review of user organizations written consultation-responses. Additional literature was found through the use of techniques from systematic literature search, as well as hand searching in the curriculum. The findings show that the user organization support the suggested model, as presented in NOU 2019: 26 - “Reform on Illegal Drug Use – from Punishment to Support». There has, however, been made adjustments to this model in the final proposition that counter the user perspective. These are discussed as well as other prominent notions; the wish for a more comprehensive reform and change of attitudes towards people who use drugs. User-participation is seen as important for further implementation of the user perspective. Implications of these findings for social work are also discussed briefly.
