"Det er vanskelig å skulle lære opp noen til noe, når loven sier noe helt annet" - En kvalitativ undersøkelse av unge voksnes holdninger til voldtekt, samtykke og lovgivning i Norge

Abstract

I denne oppgaven analyserer jeg hvilke tema og diskurser unge voksne tar i bruk i dialog om voldtekt, samtykke og lovgivning. Det empiriske grunnlaget for oppgaven baserer seg på syv kvalitative intervju med unge voksne i aldersgruppen 24-30 år. Med utgangspunkt i Straffeloven §291 og det foreliggende forslaget til norsk samtykkelov, undersøker jeg hvordan informantene forholder seg til og reflekterer over ulike aspekter som sentrale for voldtektsdefinering og lovgivning. Det teoretiske rammeverket tar utgangspunkt i diskurspsykologiske tilnærminger og kjønnsstudier, med fokus på forståelser av kjønn, makt, maskulinitet og femininitet.

Analysen består av tre kapittel, som belyser ulike sentrale konsepter i informantenes fortellinger og forståelser. Det første kapittelet baserer seg på en tematisk analyse av informantenes fortellinger om kommunikasjon og porno som vesentlige tema for hvordan mennesker blir sosialisert til å forstå hvordan samtykke ser ut og gjøres i praksis.

De to påfølgende analysekapitlene baserer seg på diskurspsykologisk analysestrategi, med fokus på fortolkningsrepertoar og subjektposisjoner som informantene trekker på i fortellinger om voldtekt, samtykke og lovgivning. Det andre kapittelet tar for seg informantenes holdninger og oppfatninger til voldtektslovgivning. Her analyserer jeg hvordan informantene trekker på forståelser av vold og truende atferd som aspekt ved voldtekt, og hvordan de trekker på ulike forståelser av fysisk og psykisk vold. I tillegg analyserer jeg hvilke betoninger av offerrollen som gjør seg gjeldende i overgrepssaker og hvilke posisjoneringer til en samtykkelovs samfunnsverdi som trekkes på hos informantene.

Det tredje kapittelet tar for seg informantenes ulike perspektiver og holdninger til hvordan samfunnet forholder seg til kjønn som faktor i overgrepsproblematikk og voldtektslovgivning. Her analyserer jeg informantenes refleksjoner til en kjønnet sexkultur, som legger føringer for hvordan kvinner og menn forventes å opptre i seksuelle relasjoner. I tillegg analyserer jeg informantenes forståelser av hvordan kunnskap om samtykke kan bidra til seksuell og kroppslig autonomi.

In this assignment, I analyse the themes and discourses young adults employ in discussions about rape, consent, and legislation. The empirical foundation of the assignment is based on seven qualitative interviews with young adults aged 24-30. Drawing on Section 291 of “Straffeloven” and the proposed Norwegian consent law, I examine how the informants engage with and reflect upon various aspects central to defining rape and legislation. The theoretical framework draws on discourse psychological approaches and gender studies, focusing on understandings of gender, power, masculinity, and femininity.

The analysis consists of three chapters, which illuminate various central concepts in the informants' narratives and understandings. The first chapter is based on a thematic analysis of the informants' narratives about communication and pornography as essential themes for how individuals are socialized to understand what consent looks like and how it is practiced. The two subsequent analysis chapters are based on discourse psychological analysis strategies, focusing on interpretive repertoires and subject positions that the informants draw upon in narratives about rape, consent, and legislation.

The second chapter examines the informants' attitudes and perceptions towards rape legislation. Here, I analyse how the informants draw on understandings of violence and threatening behavior as aspects of rape, and how they draw on various understandings of physical and psychological violence. Additionally, I analyse the emphasis on the victim role in abuse cases and the positioning towards the societal value of a consent law that informants draw upon.

The third chapter explores the informants' various perspectives and attitudes towards how society addresses gender as a factor in issues of abuse and rape legislation. Here, I analyse the informants' reflections on a gendered sexual culture, which dictates how women and men are expected to behave in sexual relationships. Additionally, I examine the informants' understandings of how knowledge about consent can contribute to sexual and bodily autonomy.
