Bioingeniører og deres taushetsplikt

Abstract

Hensikten med oppgaven vår var å undersøke eventuelle brudd på taushetsplikten blant bioingeniører, og i hvilke situasjoner dette kan forekomme. På Norske sykehus er det vanlig praksis med flere pasienter på samme pasientrom. Noen sykehus praktiserer også flere pasienter på samme polikliniske prøvetakingsrom, som kun blir adskilt av en tynn gardin. Dette skaper store utfordringer for bioingeniører i forhold til å overholde taushetsplikten. I denne oppgaven har vi undersøkt hvordan bioingeniører, 3. Års bioingeniørstudenter og personer med sykehuserfaring opplever prøvetakning under slike forhold. For å samle inn data har vi benyttet oss av to ulike spørreskjemaer. Et til bioingeniører og et til bioingeniørstudenter. Vi har gjennomført intervju av informanter, og benyttet etiske drøftningsmetoder. Ved å bruke en kombinasjon av etisk fagteori og benytte oss av idegrunnlaget til etikkfilosofer som Skjervheim, Løgstrup og Kirkegaard har vi studert svarene fra respondentene og informantene. Resultatene fremstilles i tabellform og løpende tekst, med påfølgende drøfting. Vi har presentert forslag til mulige forbedringer. Denne studien viser at måten norske sykehus er utformet, resulterer i at bioingeniører i prøvetakingssituasjoner i praksis tvinges til å bryte taushetsplikten på daglig basis.

The purpose with this study was to examine how common duty of confidentiality for patients are violated by medical laboratory technologists, and when this violation occurs. It is common practice in Norwegian hospitals to accommodate more than one patient in the same patient room. Some hospitals also practice phlebotomy of multiple patients in a single out-patient clinic, separated only by a thin curtain. This causes big challenge when it comes to protecting confidentiality for patients. Our aim was to find out how medical laboratory technologists, medical laboratory technologist students and individuals with experience from Norwegian hospitals, feel about working with patients under these circumstances. Mainly where the confidentiality for patients are prevented by conditions mentioned above. For collecting data to our study, we have created two different kinds of questionnaires. One dedicated to medical laboratory technologists and one to students. In addition to the questionnaires, we conducted interviews of individuals with experience from Norwegian hospitals. The feedback from responders have been studied and rated by combining ethical theory and utilize the basic of fundamental ideas by philosophers like Skjervheim, Løgstrup and Kirkegaard. The results are presented in tables, complemented with continuous text and discussion. Eventually we have presented suggestions for improvement. This study indicates that the way Norwegian hospitals are organized, when it comes to handle patients’ blood samples (and other kinds of tests/samples), medical laboratory technologists have no other choice than to violate confidentiality for patients on daily basis.
