dc.description.abstractUtbyggingsavtaler er et verktøy for kommunen og utbygger som skal sikre gjennomføring av rekkefølgebestemmelser i reguleringsplan. Tidligere har det offentlige hatt en ledende rolle innen arealplanlegging i Norge, men i dag legges dette i større grad over på private aktører. I den forbindelse har utbyggingsavtaler vokst fram som et verktøy for samarbeid mellom kommune og utbygger/grunneier. Det er vanlig å bruke utbyggingsavtaler i forbindelse med større transformasjonsområder. Formålet med denne oppgaven er å rette søkelys mot samspillet mellom kommune og utbygger fram mot utarbeidelsen av utbyggingsavtaler. Studien søker å belyse denne problemstillingen: «Finnes det muligheter for optimalisering av forhandlingsprosessen fram mot utarbeidelse av utbyggingsavtaler mellom kommune og utbygger?». Oppgaven skal avdekke hvilke metoder og modeller som finnes i Trondheim og Stavanger for forhandling av utbyggingsavtaler, derunder avklare krav og forventninger mellom partene. På bakgrunn av denne informasjonen vil aktuelle utfordringer med forbedringspotensial i forhandlingsprosessen og samspillet drøftes. For å kunne besvare problemstillingen og underliggende forskningsspørsmål, ble det gjort en innledende litteraturstudie. På bakgrunn av litteraturstudiet ble det videre gjennomført tre innledende intervjuer, henholdsvis to kommunale aktører og en utbygger. Deretter ble det gjort en ny runde med litteraturstudie basert på svar fra de tre innledende intervjuer, som igjen førte til en konkretisert intervjuguide i forkant av dybdeintervju. Litteraturstudiet og innledende intervjuer utgjorde kombinert oppgavens fundament for gjennomføring av 10 dybdeintervju med kommunale aktører og utbyggere i Trondheim og Stavanger. Oppgavens kvalitative art vil imidlertid medføre at generaliserende konklusjoner ikke kan oppnås. Oppgaven har avdekket at bruk av mal for utbyggingsavtaler øker forutsigbarheten for partene, men innskrenker utbyggers forhandlingsrom. Det framgår av funn at utbygger har en svak forhandlingsposisjon i sammenheng med utbyggingsavtaler. Undersøkelsen har vist at en mulig årsak er vaghet i bestemmelsene innen prinsippene om forholdsmessighet, nødvendighet og rimelighet. Dette åpner for at kommunen kan foreta skjønnsmessige vurderinger, som i kombinasjon med utbyggers behov for framdrift kan føre til ubalanserte byrdefordelinger. Videre har oppgaven avdekket at kommuner har behov for mer kompetanse om prosjektøkonomi med hensyn til utbyggers gjennomføring. Oppgaven foreslår at utbygger involveres i de uformelle vurderingene/evalueringene som kommunen gjør i forbindelse med utbyggingsavtaler, for å fremme gjensidig gevinst i senere samarbeid.
dc.description.abstractDevelopment agreements are a tool for the municipality and the developer that will ensure the implementation of order provisions in the zoning plan. In the past, the public sector has played a leading role in spatial planning in Norway, but today this is to a greater extent transferred to private actors. Development agreements have emerged as a tool for cooperation between the municipality and the developer / landowner, and is common to use in conjuction with larger transformation areas. The purpose of this thesis is to focus on the interaction between the municipality and the developer towards the preparation of development agreements. The study seeks to throw light on this issue: "Is it possible to optimize the negotiation process leading up to the production of development agreements between the municipality and the developer?". The thesis will address the methods and models that exist in Trondheim and Stavanger for negotiating development agreements, including clarifying demands and expectations between the parties. On the basis of this information, current challenges with potential for improvement in the negotiation process and the cooperation will be discussed. In order to answer the problem and underlying research questions, an initial literature study was conducted. On the basis of the literature study, three introductory interviews were conducted, two municipal actors and one developer, respectively. Then a new round of literature study was carried out based on answers from the three introductory interviews, which in turn led to a concretized interview guide prior to the in-depth interviews. The literature study and initial interviews formed the combined foundation of the thesis for conducting 10 in-depth interviews with municipal actors and developers in Trondheim and Stavanger. However, the qualitative nature of the thesis will mean that generalizing conclusions cannot be achieved. The thesis has revealed that the use of a template for development agreements increases the predictability of the parties, but restricts the developer's bargaining power. It appears from the findings that the developer has a weak negotiating position in conjunction with development agreements. The study has shown that a possible reason is vagueness in the provisions within the principles of proportionality, necessity and reasonableness. This allows the municipality to make discretionary assessments, which in combination with the developer's need for progress can lead to unbalanced burden distributions. Furthermore, the thesis has revealed that municipalities need more expertise on project finances with regard to the developer's implementation. The thesis proposes that the developer is included in the informal assessments / evaluations that the municipality makes in conjunction with development agreements, in order to promote mutual benefit in later cooperation.
