dc.description.abstractForeliggende masteroppgave er en studie av bruk av rekkefølgebestemmelser knyttet til skolekapasitet i reguleringsplanlegging. Utbyggere i Trondheim får ikke godkjent byggesøknader dersom det ikke er tilstrekkelig dekning av skoleplasser i en skolekrets. Dette kan føre til store forsinkelser og ekstra utgifter for utbyggerne, potensielt også for kommunen, dersom bygningsmyndigheten avslår søknader som ellers er i tråd med overordnede planer. Ved utbygging av flere boliger i en bydel vil behovet for skoleplasser øke, og det må derfor bygges nye skoler. Dersom kommunen ikke prioriterer skolebygging, står utbyggerne fast, i og med at det ikke er tillatt å la private aktører bygge ut sosial infrastruktur. Dette gjør byggeprosjekter uforutsigbare og vanskelig å planlegge. En ambisjon med oppgaven har vært å forsøke og finne ut hvordan kommunen og utbyggere i fellesskap kan finne løsninger som gjør situasjonen mer forutsigbar og fører til mindre samfunnsøkonomisk tap. Denne masteroppgaven undersøker konsekvenser av byggestans som følge av rekkefølgekrav knyttet til skolekapasitet. Tittelen på oppgaven er: Bruk av rekkefølgebestemmelser om tilstrekkelig skolekapasitet i reguleringsplaner. En casestudie basert på forsinket utbygging av Granås Ungdomsskole i Trondheim. Problemstillingen lyder følgende: Hva er konsekvensene av bruk av rekkefølgebestemmelser om tilstrekkelig skolekapasitet i reguleringsplaner, og kan bedre samhandling redusere ulempene for aktørene? Oppgaven tar i bruk kvalitative forskningsmetoder hvor åtte intervjuer er gjennomført. Fire private aktører og fire offentlige tilsatte er intervjuet for å klarlegge prosessen rundt Granås og holdninger generelt hos aktørene. I tillegg er det utført et dokumentstudium av saksdokumenter i bygningsrådet fra tidligere behandlede saker i skolekretsen. Som del av dokumentstudiet er også epostkorrespondanse mellom utbyggerne som ble rammet av byggestansen i Østbyen i Trondheim gjennomgått. Problemstillingen besvares gjennom seks forskningsspørsmål, som blir drøftet i lys av plan og eiendomsteori samt funn av data gjennom empiri. Studiet avdekker store forskjeller i oppfatningen av hva som har skjedd i den konkrete saken Granås, og hvem som er ansvarlig. Samtidig avdekker intervjuene at respondentene på generell basis ikke har så ulikt syn på hva som burde skje i slike saker. Det fremkommer at nåværende planer, saksbehandling og rutiner hos kommunen ikke er gode nok for å skape forutsigbarhet i bransjen samtidig med at samarbeidet mellom administrativt, politisk nivå og utbyggerbransjen ikke er optimalt. Dokumentstudien viser i tillegg at saker som fremmes for behandling har begrenset vurdering av juridiske aspekter. Studien viser også at det er utstrakt lobbyvirksomhet i caset. Avslutningsvis diskuteres det løsningsforslag gjennom drøfting av funnene. Basert på intervju og dokumentstudie konkluderes det med at åpenhet og dialog mellom partene er sentralt. Samtidig bør det vurderes rutineendringer hos kommunen med tanke på utforming av kommuneplanens arealdel, og innføring av tidsfrister.
dc.description.abstractThe present master's thesis is a study of the use of sequencing provisions related to school capacity in zoning planning. Developers in Trondheim will not get building applications approved if there is insufficient coverage of school places in a school district. This can lead to major delays and extra costs for the developers, potentially also for the municipality, if the building authority rejects applications that are otherwise in line with overall plans. When developing more homes in a district, the need for school places will increase, and new schools must therefore be built. If the municipality does not prioritize school construction, the developers will be stuck, because it is not permitted for private actors to expand social infrastructure. This makes construction projects unpredictable and difficult to plan. An ambition with the the thesis has been to try and find out how the municipality and developers together can find solutions that make the situation more predictable and lead to less socioeconomic loss. This master's thesis examines the consequences of construction stoppage as a result of sequence requirements related to school capacity. The title of the thesis is: Use of sequence provisions on sufficient school capacity in zoning plans. A case study based on the delayed development of Granås Ungdomsskole in Trondheim. The main research question is the following: What are the consequences of using sequence provisions on sufficient school capacity in zoning plans, and can better collaboration reduce the disadvantages for the actors? The thesis uses qualitative research methods where eight interviews have been conducted. Four private actors and four public employees were interviewed to clarify the process around Granås and attitudes in general among the actors. In addition, a study of public documents from the building councel has been carried out examining previously processed cases in the school district. As part of the study of documents, email correspondence between the developers who were affected by the construction stoppage in Østbyen in Trondheim has also been reviewed. The main research question is answered through six sub-research questions, which are discussed in the light of plan and property theory as well as findings of data through empirical data. The study reveals major differences in the perception of what has happened in the specific case of Granås, and who is responsible. At the same time, the interviews reveal that the respondents on a general basis do not have such a different view of what should happen in such cases. It emerges from the current planning, case processing and routines at the municipality are not good enough to create predictability in the industry at the same time as the cooperation between the administrative, political level and the developer industry is not optimal. The study of documents also shows cases that are submitted for processing have a limited assessment of legal aspects. The study also shows that there is extensive lobbying in the case. In the end, solution proposals are discussed through discussion of the findings. Based on the interview and study of documents, it is concluded that openness and dialogue between the parties is key. At the same time, changes in routines should be considered by the municipality with a goal to designing the area part of the municipal plan, and introducing deadlines.
