Abstract
Vold er et globalt problem, og som i Norge i dag blir sett på som svært alvorlig. Det er flere lover som skal hindre Norges innbyggere fra å bruke den skadelige praksisen på barn. Likevel kan det komme utfordringer når det kommer minoritetsfamilier til Norge, med andre kulturer og holdninger til vold. I denne oppgaven skal jeg fokusere på barnevernets arbeid med etniske minoritetsfamilier som utfører oppdragervold. Jeg vil drøfte følgende problemstilling: «Hva er årsaken, og hva blir konsekvensene, når et barn utsettes for oppdragervold og hvilke utfordringer kan barnevernet møte i arbeidet med minoritetsfamilier?» Jeg vil avgrense i forhold til kultur, alder og utfordringer knyttet til dette.
I oppgaven har jeg hatt fokus på forskning som viser til skadevirkningen volden har på barn. Jeg har også fokusert på lovverket for å finne ut rettighetene barn har, i tillegg til hvilke rettigheter som setter grenser for vold. Videre drøfter jeg hvordan kultur kan gi forskjellige syn og holdninger til oppdragervold, med utgangspunkt i det norske lovverket, har jeg undersøkt barns rettigheter og rettslige grenser og i hvilken grad kulturkompetanse og kultursensitivitet i barnevernet kan være verdifullt i møte med etniske minoriteter som utøver oppdragervold. I tillegg drøfter jeg utfordringen barnevernspedagoger møter i et strengt fastlagt lovverk som omhandler ulovligheten til oppdragervold, når man i tillegg skal vise sensitivitet ovenfor kulturen til familien. Violence is a global problem, and which in Norway today is seen as very serious. There are several laws that will prevent the inhabitants of Norway from using the harmful practice on children. Nevertheless, there may be having issue when minority families come to Norway, with other cultures and attitudes to violence. In this thesis is about Child Protective Services work with ethnic minority families which practice corporal punishment. The thesis is based on the following issue: “What is the cause, and what will be the consequences, when a child is exposed to corporal punishment and what challenges will the Child Protective Service face when working with minority families?” I want to delimit in the relation to vulture, age and challenges related to this.
In the thesis, I have focused on research that refers to the harmful effects of violence on children. Furthermore, I discuss how vulture can provide different views and attitudes to custodial violence, based on Norwegian law, I have examined children´s rights and legal boundaries and the extent to which cultural competence and cultural sensitivity in child welfare can be valuable in dealing with ethnic minorities who commit corporal punishment. I also discuss the challenge child welfare educators face in a strictly established legislation that deals with the illegality of parent violence, when one must also show sensitivity to the culture of the family.
