dc.description.abstractSammendrag «Tvist» og «konflikt» er to begrep som ofte er benyttet i forbindelse med utfordringer på arbeidsplasser, og som trolig blir brukt mye om hverandre i byggenæringen. Konfliktnivået i næringen ansees å være høyt, muligens høyere enn i de fleste andre næringsvirksomheter. Dette kan antas å være et resultat av fragmenteringen i bransjen – den består av flere ulike type aktører, komplekse design, ulike prosjektfaser og midlertidige prosjektorganisasjoner. Ved hjelp av en casestudie av det nye Deichmanske hovedbibliotek i Oslo i samarbeid med entreprenørfirmaet AF Gruppen (forretningsenhet: AF Byggfornyelse), har det blitt mulig å undersøke emnet nærmere. En hovedproblemstilling med fire tilhørende forskningsspørsmål er blitt formulert som følger: Hvilke erfaringer kan hentes fra konflikt- og tvisteforløp i prosjektet: Nye Deichmanske hovedbibliotek? 1. Hva er grensesnittet mellom begrepene «tvist» og «konflikt»? 2. Hva er de viktigste årsakene til utvikling/avvergelse av konflikt (inkludert premisser og situasjonsparametere) på prosjektet? 3. Hva slags konsekvenser skaper konfliktene? 4. Hva slags innvirkning har tillit hatt på konfliktene i prosjektet? For å kunne besvare hovedproblemstillingen og forskningsspørsmålene, er det blitt valgt å benytte metodetrianguleringsprinsippet. Metodetrianguleringen består av et litteratursøk og en casestudie. Casestudien er todelt består av et dokumentstudie og kvalitative, semistrukturerte intervjuer. Litteratursøket har som mål å presentere de mest sentrale aspektene innen emnet som har blitt forsket på i løpet av de siste årene. Dokumentstudiet baserer seg på relevante dokumenter fra casestudieprosjektet, nyhetskilder fra media, samt juridiske dokumenter og standarder som kan relateres til casestudieprosjektet. Intervjudelen bestod av 12 intervjuer av til sammen 14 representanter som har vært involvert i casestudieprosjektet. Metoden har gjort det mulig å sammenligne empiriske funn med eksisterende teori. Resultatene fra studiene viser at det er ulike oppfatninger av begrepene «tvist» og «konflikt», både fra teorien og fra intervjuobjektene. Tvister er imidlertid objektive, saklige og er knyttet til kontraktuelle eller rettslige grunnlag. Konflikter går mer på det personlige plan, er subjektive, usaklige og det trengs en tredjepart som må hjelpe å løse konflikten. Fra intervjuene ble 11 nye årsaker til utvikling av konflikt identifisert som tillegg til årsakene som var identifisert fra teorien. Det var seks årsaker som ble sterkest vektlagt blant intervjuobjektene: kontraktsavvik, stramme budsjetter, svak ledelse og planlegging, krav på tilleggsbetalinger, tidspress og for stor/omfattende prosjektorganisasjon. Tre identifiserte årsaker til avvergelse av konflikt var kommunikasjon, rask beskjed og dokumentasjon og det å være løsningsorientert. Det har også fra casestudien blitt identifisert fem premisser og situasjonsparametere som enten har bidratt positivt, negativt eller begge deler, på prosjektets konfliktnivå: entrepriseform, samhandlingsfase, stor prosjektorganisasjon, type bygg og kompleksiteten bak det og kommunikasjonsteknologi. Svar fra intervjuene bekrefter det samme som er beskrevet i teorien om konsekvenser av konflikt. Konflikt bidrar til misnøye og bruk av ekstra ressurser. Tvister trenger derimot ikke nødvendigvis å bidra til negative konsekvenser. I tillegg kan det bekreftes fra casestudien at konflikter kan bidra til å svekke tillitsnivået på et prosjekt. Dog er tillit positivt for prosjektorganisasjoner, da det blant annet bidrar til at konflikter løses enklere.
dc.description.abstractSummary «Dispute» and «conflict» are two terms which are commonly used with relation to challenges in workplaces, and are probably applied interchangeably in the construction industry. The conflict level in the construction industry is considered to be high, possibly higher than in most other industries. This can be assumed to be a result of the fragmentation in the industry – it consists of several different types of actors, complex designs, varying project phases and temporary short-term project organizations. By conducting a case study of the New Oslo Public Library (Deichman library) in collaboration with the contracting firm AF Gruppen (business unit: AF Byggfornyelse), it has been possible to investigate the topic more closely. A central problem with four respective research questions has been formulated as following: What experiences can be extracted from the conflict and dispute processes in the project: The New Oslo Public Library (Deichman library)? 1. What is the interface between the terms «dispute» and «conflict»? 2. What are the main causes for the development/dissuasion of conflict (including premises and situation parameters) on the project? 3. What are the consequences of the conflicts? 4. What impact does trust have on the project’s conflicts? In order to answer the central problem and the respective research questions, it has been chosen to base the research on the triangulation of methods principle. The method consists of a literature review and a case study. The case study is twofold, consisting of a document study and qualitative, semi-structured interviews. The literature review aims to present the most central aspects of the topic which has been studied through recent years. The document study is based on relevant documentation from the case study project, newspaper articles from the media, in addition to standards and court cases that can be related to the case study project. The interview segment consisted of 12 interviews with a total of 14 representatives whom all have been involved in the case study project. The method has made it possible to compare empirical findings with existing theory. The results of the studies reveal different perceptions of the terms «dispute» and «conflict», both from the theory and from the interviewees. However, disputes are objective, factual and related to contractual or legal matters. Conflicts are rather related to personal levels, and are subjective, unjustifiable and often need a third party in order to be resolved. From the interviews, 11 new causes of conflict development were identified in addition to the causes identified in the literature review. Six causes with the greatest support among the interviewees were: contract deviation, thight budgets, lack of planning and leadership, claim for additional payments, time pressure and too extensive/comprehensive project organization. Three identified causes of conflict dissuasion were communication, rapid response and documentation and the ability of being solution oriented. Five premises and situation parameters that have either contributed positively, negatively or both on the conflict level, have also been identified through the case study: contract form, partnering phase, extensive project organization, the building type and the complexity of it and communication technology. Responses from the interviews confirm the same as described in the theory regarding consequences of conflict. Conflicts contribute to dissatisfaction and the use of extra resources. However, disputes do not necessarily contribute to negative consequences. In addition, it can be confirmed from the case study that conflicts can contribute to weakening of the level of trust within a project. However, trust is positive for project organizations, as trust, among other things, contributes to resolving conflicts more easily.
