dc.description.abstractNORSK: Oppgaven studerer hvordan en hovedleverandør i norsk byggenæring kan oppfylle påseplikten og unngå et solidaransvar for lønn, fastsatt i lov om solidaransvar av 1.jan 2010. Det er intervjuet seks hovedleverandører i bransjen, tre i Oslo og tre i Gjøvik-distriktet. Resultatet av kartleggingen viser at det er en stor variasjon i eksisterende systemer og rutiner blant samtlige leverandører i studien. Allikevel går det et klart skille mellom by og land i omfanget og i antall rutiner, der distriktet har vesentlige mangler sett i forhold til de landsdekkende. Studien viser at det er et behov for oppdatering av dagens kontrakter og praktiske rutiner. Viktige forbedringer vil være å forsterke forebyggende tiltak som videreutvikling av og mer aktiv bruk av StartBANK, utvidet innsyn, forlenget bankgaranti, strengere regresskrav og åpenhet rundt arbeidstakers rettigheter. Dette er virkemidler for å redusere sannsynligheten for et solidaransvar.en_US
dc.description.abstractENGELSK:The thesis studies how a main supplier in the Norwegian construction sector can fulfill the obligation to ensure correct wages and working conditions and to avoid a joint and several liability, set forth in the Act on joint and several liability of January 1, 2010. There are interviewed six main suppliers in the industry, three in Oslo and three in the district of Gjøvik. The results of the survey show that there is a large variation in the existing systems and practices among all vendors in the study. Yet there is a clear distinction between Oslo and Gjøvik in scope and in number of procedures, which the district of Gjøvik has significant shortcomings in relation to vendors in Oslo. The study shows that there is a need for updating the current contracts and practical procedures. Significant improvements will be to reinforce the preventive measures that further development of, and more active use of StartBANK, expanded document inspection, extended bank guarantee, strict subrogation claims and transparency around employee rights. These are measures to reduce the probability of a joint and several liability.en_US
