Barnets beste i familiepolitikk - Hensynet som ble glemt?

Abstract

Denne oppgaven belyser hvordan barnets beste kommer til syne i Norske offentlige utredninger (NOU) som omhandler familiepolitikk. Barnets beste er et vidt begrep, hvor diskurser bidrar til å forme begrepets innhold og anvendelse. Oppgaven støtter seg til teorier om ulike perspektiver på barn, barnets medvirkning og familiepolitikk. Analysen finner to diskurser som resultat av diskursanalysen som ble gjennomført på seks NOUer utgitt mellom 2008 og 2019. Oppgaven peker på eksistensen av en overordnet enighet om selve begrepet barnets beste i de offentlige utvalgene, men en uenighet om hvordan begrepet skal forstås, tolkes og anvendes. Analysen argumenterer for at de to diskursene kan anses som barneorientert eller foreldreorientert og peker på diskursenes ulike teori- og perspektivgrunnlag. Diskursene har en historisk utvikling, hvorpå denne oppgaven argumenterer for at det er den foreldreorienterte diskursen som er ledende i å forme forståelsen av barnets beste i de nyeste NOUene utgitt innenfor det familiepolitiske feltet.

This thesis sheds light on how the child’s best interest is reflected in Official Norwegian Reports (NOU) regarding family policies. The best interest of the child is a broad concept, where discourses contribute to forming the content and application. The thesis is based on theories on childhood perspectives, children’s right to participate and family policy. The analysis is the result of a discourse analysis conducted on six NOUs published between 2008 and 2019. The thesis point to the existence of an overall agreement on the concept ‘the best interest of the child’ in the Official reports, but also shows a disagreement on how the concept should be understood, interpreted and used. The analysis argues that the two discourses can be regarded as child-oriented and parent-oriented and points to the discourses’ different theoretical and perspective bases. The discourses have a historical development, whereupon this thesis argues that it is the parent-oriented discourse which are currently defining the concept ‘the best interest of the child’ in the latest NOUs published within the field of family policy.
