Problemstilling:
Hvordan kan vanlige mistolkninger av meldeplikten påvirke barnevernets plikt til åsamarbeide med barn og foreldre?
Bakgrunn:
Jeg har i denne oppgaven undersøkt nærmere hvordan misforståelser av meldeplikten har sattseg i praksis, og hvilke konsekvenser dette kan føre til for barnevernets videre arbeid. Med enteoretisk innføring av lovverket med fokus på taushetsplikten og meldeplikten har jeg sattopp lovens forarbeider opp mot hvordan loven i mange tilfeller praktiseres.Barnevernstjenesten (bvtj.) er avhengig av «samarbeidsaktører» som skolen, og at disseaktørene opprettholder meldeplikten etter de kravene som er beskrevet i bvl. §6-4 1. ledd.Behovet for å motta opplysninger om barn i alvorlige omsorgs- og livssituasjoner gjør atbarnevernstjenesten skal kunne ivareta sine lovpålagte oppgaver (prop 169l, 14.6.1). Dette girdisse «samarbeidsaktørene» en viktig oppgave, der barnevernets arbeid forutsetter at disseaktørene kjenner til, og praktiserer lovverket riktig.
Konklusjon:
I lys av relevant teori har jeg brukt rapporter og studier som viser at spesielt skolen og deresansatte ikke nødvendigvis alltid benytter loven slik den er tiltenkt. Dette har gjort at jeg harkonkludert med at denne kunnskapen i første omgang må ligge til grunn for at viderepraktisering av lovverket skal kunne bli mulig. Videre har jeg konkludert med at dersom denkommunalt ansatte som er underlagt taushetsplikten kjenner til lovverket, men fortsatt er i tvilom hva som skal gjøres, bør ta kontakt med barnevernstjenesten, eller team innad i skolen.Her er det viktig å anonymisere den aktuelle saken for å få nye perspektiver angående hvasom bør gjøres videre. Research question:
How can common misinterpretations of the obligation to report to the municipal childwelfare service’s affect the duty to cooperate with children and parents?
Background:
In this thesis, I have investigated in more detail how misunderstandings of the obligation tonotify the municipal child welfare services have arisen in practice, and what consequencesthis may lead to for the municipal child welfare service’s further work. With a theoreticalintroduction of the legislation with a focus on the duty of confidentiality and the obligation tonotify the child welfare services, I have set up the preparatory work for the law against howthe law is practiced in many cases. The municipal child welfare service is dependent on“collaborative actors” such as the school, and that these actors maintain the obligation tonotify in accordance with the requirements described in the child welfare service’s law § 6-4.The need to receive information about children in serious care and life situations means thatthe child welfare service becomes able to fulfill its statutory tasks according to thepreparatory work for the law. This gives these “collaborative actors” an important task, wherethe child municipal child welfare service’s work presupposes that these actors know andpractice the legislation correctly.
Conclusion:
In the light of relevant theory, I have used reports and studies that show that especially theschool and their employees do not necessarily always use the law as it is intended. This hasled med to conclude that this knowledge in the first instance must be the basis for furtherpractice of the legislation to be possible. Furthermore, I have concluded that if the municipalemployee who is subject to the duty of confidentiality knows the legislation, but is still indoubt about what to do, should contact the municipal child welfare service, or team withinthe school. Here it is important to anonymise the current case in order to gain newperspectives regarding what should be done next in the case.
